The ColorBar Contest Rules
ELIGIBILITY AND CONDITIONS
To Enter and be eligible to win, a person must (at the time of entry) be a legal resident of Canada (excluding Quebec Province, where it is void).
The « COLORBAR » Contest (“Official Rules”)
No Purchase necessary to enter or win.
The « COLORBAR » Contest(the “Contest”) is sponsored by Backstage Commerce Inc. (the “Sponsor” or “BSC”).
1. CONTEST PERIOD
The contest will begin and end at the following times (the “Contest Period”): begins at 12:00:01 am Eastern Time (“EST”) onJuly, 01, 2017 and ends at 11:59:59 a.m. EST on August, 31, 2017.
2. FACEBOOK
The Contest is in no way sponsored, endorsed, administered by, or associated with Facebook. Any questions, comments, or complaints regarding the Contest should be directed to the Sponsor. By entering this Contest, entrants agree to release Facebook from any claims or liability whatsoever, relating to the Contest.
3. HOW TO ENTER AND BE ELIGIBLE FOR A PRIZE
To enter the Contest and be eligible for a Prize, during the Contest Period, entrants must :
1) Visit http://backstagecommerce.ca/colorbar/
2) Complete and Submit the Form
Only one (1) email, per person, may be used to enter the Contest. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to use multiple names, identities, email addresses, social media accounts and/or any automated, macro, script, robotic or other system(s) or program(s) to register for or otherwise participate in or disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.
Entries submitted in accordance with these Official Rules shall be referred to hereafter as the “Eligible Entries”. Entries must be received on or before the end of the Contest Period.
4. PRIZES
A color bar fully supplied with Lakmé products + in-salon training for a total value of $5000.
Prizes must be accepted as awarded, are not transferable or convertible to cash. The Sponsor reserves the right at any time to substitute a Prize or a component thereof for any reason with a Prize or a prize component of equal or greater value, or the value of the Prize in cash as indicated in these Official Rules.
5. SELECTION OF PRIZE WINNER
The Eligible Entries will be chosen by BSC and/or its representatives.
In the event no Eligible Entries are received, the Prizes will be void.
6. WINNER NOTIFICATION
The Sponsor will attempt to contact the selected entrant by email. The selected winner will have twenty-four (24) hours after being selected to send the Sponsor a message to arrange the winner confirmation process and if applicable, Prize delivery.
Before being confirmed as a Prize winner, the selected entrant must: (i) correctly answer, unaided, a time-limited, mathematical skill-testing question; and (ii) confirm acceptance of the terms of the Liability/Publicity Release that the Sponsor will provide, by signing and returning it within the time set by the Sponsor. If a selected entrant (a) cannot be reached by reasonable efforts within one (1) day of being selected; (b) fails to correctly answer the mathematical skill testing question; (c) fails to sign the Liability/Publicity Release Form (d) otherwise is not in compliance with these Official Rules; then he/she will be disqualified and will forfeit the Prize and, at the Sponsor’s sole discretion, an alternate entrant may be randomly selected until the selected entrant meets all the qualifications outlined in these Official Rules and can be declared a winner. The Sponsor will not be responsible for failed attempts to contact a selected entrant.
Delivery of Prizes will be coordinated with the confirmed winner by the Sponsor upon receipt of his/her Liability/Publicity Release Form.
7. GENERAL
a) Entries received shall be deemed to be submitted by the authorized email account holder associated with the entry. For purposes of these Official Rules “authorized account holder” is defined as the natural person who is assigned to an email account. Each potential winner may be required to provide Sponsor with proof he/she is the authorized account holder of the account associated with a winning entry.
b) By entering this Contest, entrants agree to abide by these Official Rules. The decisions of the Sponsor with respect to all aspects of the Contest are final and binding.
c) By entering the Contest, entrants thereby release the Sponsor, Facebook, their parent and affiliated companies, their advertising and promotional agencies, BSC and their employees, representatives, agents, partners, shareholders, officers and directors (the “Releasees”) from all liability including responsibility for any loss, damage or injury, caused by participating or their attempt to participate in the Contest or resulting from acceptance, possession, use or misuse of a Prize.
d) As a condition of awarding a Prize, the winner of the Contest grants to the Sponsor the right to use his/her full name (first and last), image and likeness, voice, and comments for advertising, publicity, and promotional purposes without territorial, time or use limitations, including without limitation online announcements, without additional compensation or notice, unless prohibited by law.
e) The Releasees assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Releasees are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any entry to be received by the Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any damage to participant’s or any other person’s computer and other property relating to or resulting from participation in this Contest or from downloading any materials in this Contest.
f) CAUTION: ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE TO THE FULLEST EXTENT PERMITTED BY LAW.
g) By entering this Contest, each entrant consents to the collection, use, and disclosure, by the Sponsor, of the following personal information: full name (first and last), and contact information (telephone number, address, and email address) for the administration of this Contest including, but not limited to, the announcement of winners and awarding and delivery of a Prize. No commercial or other communications unrelated to the Contest will be sent to entrants, unless they have otherwise agreed to receive such communications.
h) The Sponsor reserves the right to terminate or amend this Contest at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason, such as but not limited to tampering, the Contest is not capable of running as originally planned, the Sponsor reserves the right to cancel the Contest and conduct the random draws for Prizes from all previously received Eligible Entries received by the date of cancellation.
i) The Sponsor reserves the right, in its sole discretion, to disqualify any individual who (i) tampers with, or attempts to tamper with, the entry process; (ii) enters the Contest or tries to do so by any means contrary to these Official Rules or which would be unfair to the other entrants; or (iii) violates any of these Official Rules.
j) This Contest is subject to all applicable laws and regulations.
